Appeal Court Upholds Philip Shaibu as Edo Deputy Governor, Dismisses Impeachment Appeal

The Court of Appeal in Abuja on Tuesday upheld the reinstatement of Philip Shaibu as the Deputy Governor of Edo State, affirming the earlier ruling by a lower court.

The appeal, filed by the Edo State House of Assembly, sought to validate Shaibu’s impeachment on April 8, 2024. However, the appellate court dismissed the appeal, thereby quashing the impeachment.

Shaibu’s impeachment followed the adoption of a report by a seven-member committee led by the state Chief Judge, Justice Daniel Okungbowa, which investigated allegations of misconduct. Although the panel did not substantiate the perjury claim against Shaibu, it found him guilty of disclosing government secrets.

Earlier, on July 17, Justice James Omotosho of the Federal High Court in Abuja voided the impeachment, ordering Shaibu’s immediate reinstatement. The court ruled that the allegation used to impeach him lacked legal standing and constituted gross misconduct.

Justice Omotosho also directed the Inspector-General of Police to ensure Shaibu’s security as he resumes office. The court warned that anyone impersonating the deputy governor would face legal consequences and nullified the appointment of Omobayo Godwin as Shaibu’s replacement.
